In the end, one realizes that the Supreme Court has more reverence for vague terminology such as "the general welfare" and "public good" and even higher regard for terminology not present in the Constitution, such as anything "affecting interstate commerce" as applied to the commerce clause.

Excellent copier analogy, by the way. It can be a serious problem when the 'copies' become precedents that override the original.

Coyote on Roe

The Ninth Amendment says that unlisted rights are equally as important as the listed ones. The listed ones are just there to make it extra clear.

Roe V. Wade, Privacy ... Coyote Nails It

Warren Meyer at Coyote Blog has just blown me away with Implications of a Privacy Right. The man actually sat down and read the Roe v. Wade decision. His observations are very interesting and illuminating, to say the least.

Whoever first applied the phrase "compelling state interest" to American jurisprudence really ought to be shot for treason. If he's dead, they ought to dig him up and kill him again.

It's difficult to imagine a more absolute refutation of the fundamental principles of American Constitutional government in a mere three words.
